
Montway agreed to pay a $1.45 million class action lawsuit settlement to resolve claims it contacted consumers without receiving consent required by federal law.
The settlement benefits individuals who received a call from Montway regarding its property, goods and/or services between July 16, 2017, and Aug. 3, 2021, after submitting a request for a quote or an order for Montway’s transportation services.
According to a class action lawsuit against Montway, the company violated the Telephone Consumer Protection Act (TCPA) by contacting consumers with unsolicited telemarketing calls. The TCPA requires businesses to obtain express written consent before contacting consumers with telemarketing calls, texts or faxes.
Montway is an automotive transport company that transports vehicles across the country. Consumers may have been contacted by Montway after requesting a quote or contracting services.
Montway hasn’t admitted any wrongdoing under the TCPA but agreed to pay $1.45 million to resolve these allegations.
Under the terms of the Montway lawsuit settlement, class members can receive an equal share of the net settlement fund. Payments are capped at $500 per class member. Exact payments will vary depending on the number of participating class members and the amount deducted for fees and costs.
The deadline for exclusion and objection was Jan. 13, 2023.
The final approval hearing for the settlement is scheduled for Feb. 3, 2023.
In order to receive settlement benefits, class members must submit a valid claim form by Feb. 18, 2023.
